Foreword

The General Terms and Conditions of Lerus Centers Sint-Truiden (hereinafter "Loco Casino") take effect as soon as you accept the General Terms and Conditions during registration. In the first instance, Loco Casino rejects all General Terms and Conditions of Other Parties, unless otherwise stipulated in the Contract or in these General Terms and Conditions. You also cannot derive any other rights than those described in these General Terms and Conditions. These General Terms and Conditions apply to all contracts and services of and with Loco Casino. These General Terms and Conditions also apply to the content that the Player creates or publishes on the website, including but not limited to emails, messages, photos, as well as the acquisition of prizes and the withdrawal of winnings.

By accessing the website and participating in the games of chance offered, you agree to comply fully and without reservation with these General Terms and Conditions.

1. Company Information

Upon obtaining the B+ license, Lerus Centers Sint-Truiden established the following General Terms and Conditions applicable to the website Lococasino.be. Lerus Centers Sint-Truiden (hereinafter 'Loco Casino') is a private company registered with the Belgian Crossroads Bank for Enterprises under number 0462.351.785, with its statutory office located at 8570 Vichte, Dragonderdreef 5/1. Lerus Centers Sint-Truiden operates games of chance under the Loco Casino brand via the website Lococasino.be (hereinafter the website). Lerus Centers Sint-Truiden holds the Belgian B3858 license for the operation of offline games of chance in a Class II establishment, as well as an additional Belgian B+3858 license for the operation of games of chance through information society tools. The following documents and rules are an integral part of these General Terms and Conditions for all intents and purposes, and by accepting these General Terms and Conditions, you (hereinafter the Player) confirm that you understand, accept, and also approve the Privacy Policy and the Cookie Policy.

2. Purpose of the Website

The purpose of the website is to offer the Player both free and/or paid games of chance, which are available on the website and for which Loco Casino operates under the authority of the Belgian Gaming Commission.

3. Definitions

3.1 Day: calendar day;

3.2 General Terms and Conditions: these General Terms and Conditions;

3.3 Loco Casino: service provider;

3.4 Service: games of chance and tournaments offered by Loco Casino under the Gaming License;

3.5 Customer Service: Loco Casino’s Support and Assistance body;

3.6 EPIS: Excluded Persons Information System;

3.7 Intellectual Property Rights: all intellectual property rights related to the website and services, including: patent rights, copyright, trade name rights, trademark rights, design rights, database rights, and related rights;

3.8 PEP: politically exposed person, including immediate family members and associates of the person concerned;

3.9 Player Account: the Player’s account in Loco Casino’s gaming system, used exclusively for the purpose of participating in the Services;

3.10 Gaming Winnings: the amount acquired by participating in the Services;

3.11 Player: Loco Casino’s customer, registered as a Player;

3.12 Player Account: the personal environment accessed by a Player after successfully registering as a Player; Player Accoun

3.13 License: the Belgian B+ license for the operation of a Class II online casino via an information society instrument;

3.14 AML Law: the Law on the Prevention of Money Laundering and Terrorist Financing and the Limitation of Cash Use;

3.15 Website: the website where Loco Casino offers online games of chance.

4. Applicability

4.1 The General Terms and Conditions of Loco Casino apply to all Services offered by Loco Casino on the website.

4.2 The General Terms and Conditions of any other party are, in principle, excluded. Only when the parties have expressly agreed in writing will Loco Casino’s General Terms and Conditions not apply.

4.3 If one or more provisions of these General Terms and Conditions are deviated from in any way, the other provisions will continue to apply.

4.4 Any modifications to these General Terms and Conditions agreed upon in writing will only apply to the specific cases determined in that particular agreement.

4.5 Once accepted for the first time, the General Terms and Conditions do not need to be expressly agreed upon again each time but are deemed to be tacitly accepted.

4.6 The General Terms and Conditions are valid for an indefinite period, until the Player closes their Player Account in accordance with the General Terms and Conditions.

5. Disclaimer Clause

Loco Casino offers the opportunity to participate in games of chance on Lococasino.be. By checking the box "I am 21 years or older and I accept the General Terms and Conditions," this will be considered an electronic signature, and you confirm that you have read the Privacy Policy and the General Terms and Conditions, that you understand them, and fully accept all of their provisions. The checkbox appears during registration.

6. Use of the Website

6.1 General Provisions

6.1.1 The Belgian Gaming Commission may deny access to online games of chance in certain cases by verifying the Player's identity using the EPIS database. Loco Casino is not responsible if access to the website is restricted by the Belgian Gaming Commission.

6.1.3 The Player is not permitted to log into the website using a false or hidden IP address.

6.1.4 Loco Casino will provide you with information about our products and services through general and personalized newsletters as part of optimizing your user experience. This is a processing activity carried out as a legitimate interest of Loco Casino, but for which the Player may easily and at any time exercise the option to unsubscribe.

6.2 Registration

6.2.1 Only individuals who have legal capacity and are at least 21 years old can register to participate in games of chance and must therefore provide at least the following information:

  • Last name;

    • First name(s);

      • Address;

        • Place of residence;

          • Country of residence;

            • Date of birth;

              • Country of birth;

                • National register number for Belgian residents or another reliable identification number if the Player does not have one;

                  • Phone number / Email address

                    The above data is used to verify with the Gaming Commission whether the Player is authorized to play. At the time of registration, the IP address is also recorded. By registering, the Player consents to the processing of this data for the execution of the contract.

                    6.2.2 During registration, the Player chooses a password. There is no right to a specific password.

                    6.2.3 The following individuals will be refused registration:

                    • Individuals who wish to open an account anonymously or with insufficient documentation, making it impossible to validate the actual person;

                      • Individuals who refuse to provide the required information as outlined in this policy; • Individuals under the age of 21;

                        • Individuals listed in the EPIS database;

                          • Individuals listed in the PEP database;

                            • Individuals on a sanctions list related to asset freezes or other financial sanctions of the United Nations, the EU, and/or national lists;

                              • Individuals who have previously been refused or with whom Loco Casino has terminated the relationship.

                                6.2.4 By registering, the Player declares that they do not hold any of the following professions: judge, notary, bailiff, or member of the police services. By registering, the Player also declares that they are not listed in the EPIS database of individuals excluded by the Belgian Gaming Commission.

                                6.2.5 Loco Casino may refuse to register a new player for any reason. Loco Casino is not obligated to justify its decision to the Player.

                                6.2.6 Only one account is allowed per Player. If a Player has more than one Player Account, the Player Accounts will be closed without notice. Funds from the affected Player Accounts will be removed.

                                6.2.7 The Player declares at all times that they do not belong to any of the following groups:

                                • Individuals with a gambling addiction;

                                  • Individuals for whom a collective debt settlement application has been declared admissible;

                                    • Individuals under protection, for whom a request has been filed in accordance with Article 1239 of the Judicial Code or an official report has been drawn up in accordance with Articles 1238, § 2 and 1243 of the Judicial Code;

                                      • Individuals under protection, for whom a request has been filed in accordance with Article 5 of the law of June 26, 1990, regarding the protection of persons with mental illness.

                                        6.3 Player Account Validation

                                        6.3.1 Until the Player has uploaded a photocopy of their identification card, certain features of the website will not be available to the Player.

                                        6.3.2 Loco Casino will verify the Player's identity. For this reason, identification documents may be requested.

                                        6.3.3 The Player undertakes that all the information on their identification card is truthful, accurate, complete, and up to date.

                                        6.3.4 As soon as the verification result is positive, the Player will receive an email confirming that their Player Account has been definitively validated.

                                        6.3.5 The following data will be recorded in the Loco Casino system from the time of registration and the uploading of the identification card: first name, last name, address and place of residence, date of birth, type of identification document, date of issue of

                                        6.3.6 In addition to the above-mentioned data, Loco Casino will also process the following data:

                                        • All deposit operations, including unsuccessful transactions;

                                          • All withdrawal transactions and all internal transactions (bets, stakes, winnings, and losses);

                                            • All documents provided by the Player;

                                              • Any changes made to the Player Account, regardless of who made them.

                                                6.4 Games of Chance

                                                6.4.1 Only games of chance certified in accordance with the applicable laws and regulations in Belgium will be made available.

                                                6.4.2 In addition to the clauses set out in this document, each game includes a detailed information page with the rules and an explanation of the payout distributions. By participating in a game of chance, the Player agrees to the applicable game rules and acknowledges the risk of financial loss, waiving any legal recourse in this regard against Loco Casino. For any questions about the game rules, the Player may always contact customer service.

                                                6.4.3 Prizes and payout distributions are made completely at random through an RNG (Random Number Generator).

                                                6.4.4 It is strictly prohibited to hack or manipulate the result of the game, either directly or indirectly.

                                                6.4.5 Loco Casino reserves the right to block and/or cancel the Player’s participation in the Services and/or seize the funds available in the Player’s Account if the Player is suspected of cheating or if the Player has used a system (including, but not limited to, machines, robots, computers, software, or automated systems) designed to or capable of bypassing the client application and/or software that Loco Casino uses to provide the Services.

                                                6.4.6 The Services may be played in demo mode on the website, where the Player uses fictitious money (meaning no bet is placed using the Player Account's funds). Any winnings resulting from playing the Services in demo mode will not be credited to the Player Account.

                                                6.4.7 The Services offered by Loco Casino may be subject to conditions. There is no automatic right to participation.

                                                6.4.8 If prizes can be won by participating in the Services, this will be indicated on the platform before the start. If applicable, the description of these prizes will include any specific delivery conditions. Loco Casino reserves the right to replace a prize with another of equal value without prior notice.

                                                6.4.9 The winner of a Service is the Player who is officially declared the winner by Loco Casino after the competition. Loco Casino reserves the right to retroactively correct any erroneous game results and the winnings that resulted from them. Cash winnings will be credited to the winning Player's Account. No legal recourse is available.

                                                6.4.10 Participation in the Services is prohibited for Loco Casino employees and their family members.

                                                6.4.11 Only Services that have been played and won in accordance with the applicable game rules are considered valid wins. Additionally, the Player’s device must have a functional connection to the game server for the entire duration of the game. If a Player loses connection during a game, a computer with average player skills will complete the game for the Player. The Player has the option to rejoin the ongoing game. If the game is won by the computer or by the reconnected Player, the game stake will be refunded to the respective Player. Otherwise, the game will be considered lost for the Player who rejoined the game.

                                                6.4.12 Loco Casino reserves the right to correct or cancel results at a later time if the result of the Service was caused by a technical error, fraudulent behavior by a Player, or a false bet. If such a correction results in a negative balance on the Player’s Account, the Player will credit the equivalent amount back to the Player Account.

                                                6.4.13 Loco Casino reserves the right to claim reimbursement for any payments made in error.

                                                6.5 Communication and General Behavior Between Players

                                                6.5.1 Users will not transfer or post any content to or on the Loco Casino website that is illegal or infringes upon the rights of third parties. In particular, Players agree to:

                                                • Respect the privacy of other Players;

                                                  • Refrain from posting or creating comments on the website that are racist, xenophobic, or otherwise offensive, pornographic, or sexually inappropriate;

                                                    • Refrain from harassing or threatening other Players in any way;

                                                      • Refrain from posting advertisements or chain letters;

                                                        • Refrain from posting questionnaires or conducting surveys on the website;

                                                          • Refrain from seeking or collecting personal data about other Players without their express consent;

                                                            • Refrain from sending viruses, spam, or any other forms of disruption or interference with other systems and computer programs;

                                                              • Refrain from posting or spreading messages solely for the purpose of transmitting religious, political, or ideological content;

                                                                • Refrain from disturbing other Players, for example, by entering meaningless messages or combinations of letters;

                                                                  • Refrain from making arrangements with other Players or encouraging other Players to engage in certain behaviors;

                                                                    • Refrain from intentionally blocking, in any way, the Services and the natural flow of communication.

                                                                      6.5.2 The content transmitted or posted by the Player on the website is recorded and monitored by Loco Casino to comply with applicable law, protect the integrity of the platform, products, and the rights of other users—as outlined in the Privacy Policy.

                                                                      7. Financial Transactions

                                                                      7.1. General

                                                                      7.1.1 The payment methods are as follows:

                                                                              Credit cards are excluded from these methods. Withdrawals can only be made via bank transfer.

                                                                              7.1.2 All payments to and from the Player Account are initiated by the Player on the Player Account overview page on the website.

                                                                              7.1.3 Credit institutions and financial institutions may charge fees for incoming and outgoing payments. These fees are the responsibility of the Player. It is up to the Player to review the General Terms and Conditions of the third parties in this regard.

                                                                              7.1.4 For any transaction to or from the Player Account, the following data is recorded in compliance with the AML (Anti-Money Laundering) Law: the identity of the Player whose Player Account is debited or credited, the date and time of the transaction, the amount debited or credited during the transaction, the nature of the transaction, the type of payment instrument used for the transaction, the account number or any other unique identifier of the payment account debited or credited during the transaction, and the account number or any other unique identifier of the payment instrument used for the transaction.

                                                                              7.1.5 Payment transactions are conducted exclusively between Loco Casino and the Player. Payment transactions between the Player Accounts of different Players are not permitted.

                                                                              7.1.6 The Player acknowledges that a Player Account is not a bank account and therefore cannot be used as such. The funds in the gaming account do not generate any interest.

                                                                              7.1.7 The Player declares and guarantees to Loco Casino that the funds the Player uses to gamble on the website do not come from illegal sources and that the Player does not use the Services offered by Loco Casino to transfer funds or engage in fraudulent or illegal activities, or prohibited transactions (including but not limited to money laundering), in accordance with the laws applicable to their jurisdiction.

                                                                              7.1.8 The Player can only make a withdrawal once the corresponding Player Account has been fully validated by Loco Casino. The Player must provide a photocopy of their valid ID card, and their email address must also be validated.

                                                                              7.2 Deposits

                                                                              7.2.1 Payments to Loco Casino can only be made using the payment methods available through the Player Account overview page on the website.

                                                                              7.2.2 Payments from the Player to Loco Casino can only be made using payment methods registered in the Player's name.

                                                                              7.2.3 If Loco Casino suspects that a Player has not reached the age of 21, all wagered amounts will be refunded immediately. Additionally, all winnings acquired by the Player will be confiscated until the Player presents irrefutable proof that they have reached the minimum legal age to gamble.

                                                                              7.2.4 Upon registration, a standard deposit limit of 200 euros per week is set. This limit can be adjusted or removed under certain conditions. If the limit is increased or removed, the change will take effect after three days. A reduction of this limit takes effect immediately.

                                                                              7.2.5 The Player declares that payments to Loco Casino are used exclusively for participation in the Services.

                                                                              7.3 Withdrawals

                                                                              7.3.1 Loco Casino reserves the right to set withdrawal limits for the various payment methods. The Player has access to the respective information on the payment information page of the website, which provides details on the different payment methods and the associated limits.

                                                                              7.3.2 Payments to the Player by Loco Casino can only be made to a bank account number registered in the Player's name.

                                                                              7.3.3 All outgoing payments are subject to AML/CT (Anti-Money Laundering/Counter-Terrorism) security checks and may therefore occasionally experience delays. In such cases, our Customer Service may contact the Player, for example, as part of an additional data verification process.

                                                                              7.3.4 Loco Casino processes outgoing payments immediately after the Player has registered them. All bank transfers are treated as regular bank transfers and are sent to the banks once per business day.

                                                                              7.3.5 Loco Casino will not make a payment to the Player's bank account if all details have not been verified and if the total amount has not been used for wagering. If the Player deposits money into their Player Account, it must be wagered at least once. These transactions are monitored to prevent money laundering and the financing of terrorism.

                                                                              7.3.6 The Player can withdraw a maximum of €5,000 per day, €15,000 per week, and €25,000 per month. Loco Casino may increase these limits on an individual basis.

                                                                              7.3.7 The Player cannot request a withdrawal during an ongoing gaming session.

                                                                              8. Termination

                                                                              8.1 The Player may close their Account at any time by sending an email to support@lococasino.be. The account is officially closed when the Player receives confirmation that the account has been terminated, thus ending the business relationship between the Player and Loco Casino. Any remaining funds in the Player Account will be transferred to the Player’s registered payment account, provided there is no reason preventing the transaction. Such reasons may include, but are not limited to: unverified identity, unverified payment account, enhanced customer due diligence, etc.

                                                                              8.2 If the Player Account has been inactive for 3 months, a reminder email will be sent to the Player. However, Loco Casino reserves the right to close the Player Account if it remains inactive for 30 months.

                                                                              8.3 Loco Casino reserves the right to suspend or close a Player Account or interrupt any ongoing Services in case of violation by the Player of these General Terms and Conditions or related applicable laws, without prior notice or compensation of any kind.

                                                                              8.4 If a Player's account is suspended or closed, Loco Casino reserves the right to inform all relevant authorities, including judicial authorities, electronic payment system providers, or any other financial institution, of any illegal or suspicious activity involving the Player.

                                                                              8.5 If a Player's account is suspended or closed, Loco Casino reserves the right to suspend or cancel all transactions, bets, stakes, or payments to or from the Player's account.

                                                                              8.6 If a Player's account is suspended or closed, Loco Casino reserves the right to freeze the Player’s assets to prevent the consequences of any inappropriate, illegal, or suspicious confirmed use of the website or services offered.

                                                                              8.7 If the Player Account has been suspended or closed by Loco Casino due to a violation of these General Terms and Conditions, related documents, and/or applicable legislation, a notification will be sent to the Player by email, to the email address provided by the Player during the registration process.

                                                                              8.8 If a Player's account is suspended or closed, Loco Casino reserves the right to initiate appropriate or relevant legal proceedings to end a suspected violation by the Player, seek compensation for damages incurred by Loco Casino, or recover any winnings paid to the Player as a result of the suspected violation.

                                                                              8.9 If the Player Account has been closed by Loco Casino due to a violation of these General Terms and Conditions, related documents, and/or applicable laws, the termination of the Player Account will result in the loss of the Player's balance, including accumulated Game Winnings, without prejudice to Loco Casino’s right to initiate appropriate legal proceedings.

                                                                              8.10 If a Player has closed their account voluntarily, the option to reopen the account expires after six months.

                                                                              8.11 If a Player wishes to create a new Player Account, this can only be done seven days after the closure of the previous Player Account.

                                                                              8.12 Players whose Player Account has been closed due to irresponsible gaming, gambling addiction, or Player fraud are not allowed to re-register on the website. Loco Casino is not liable if the Player manages to open a new Player Account in any way, nor is it responsible for any direct or indirect damages resulting from this. Loco Casino reserves the right to close such Player Accounts at any time without notice.

                                                                              9. Player Responsibilities

                                                                              9.1 The Player agrees to comply with Belgian law and/or the applicable laws of their country of residence.

                                                                              9.2 The Player will not have access to the services offered by Loco Casino if the Player is under 21 years of age, lacks legal capacity, is prohibited from participating in games of chance or betting, or if the laws of the Player’s country of residence prohibit participation in games of chance. Additionally, participation is not allowed if the Player is subject to any measures, of any kind, that prohibit participation in games of chance or betting.

                                                                              9.3 Due to licensing and compliance restrictions, Loco Casino can only accept Players from certain countries. If a country is not listed on the registration form, residents and/or citizens of that country are not allowed. By registering a Player Account and using the website, the Player confirms and guarantees that online gambling is legal and permitted in the jurisdiction where the Player resides and that they will not use the website while residing or temporarily located in a jurisdiction that prohibits the use of the website. Loco Casino accepts no responsibility in this regard and will not compensate any Player for losses, fines, or other penalties or similar costs incurred as a result of violating any legal provisions applicable to the Player. The Player must ensure they are acting in accordance with all applicable laws and legal provisions in their jurisdiction at any time.

                                                                              9.4 When opening an account via Lococasino.be, the Player must accept and adhere to these General Terms and Conditions. It is the Player's responsibility to understand and follow these General Terms and Conditions. By registering and accepting these General Terms and Conditions, the Player and Loco Casino enter into a contract for the use of the services provided by Loco Casino to the Player via the website in accordance with the General Terms and Conditions.

                                                                              9.5 The Player must use their full and correct name on the website and submit all other requested information truthfully. The information provided during the registration process must remain truthful, accurate, complete, and up to date. The Player agrees to inform Loco Casino within thirty (30) days of any changes affecting the information provided during registration. If it appears that these registration conditions are not (or no longer) met or that the information provided is not (or no longer) correct, truthful, complete, and/or up to date, Loco Casino reserves the right to deny access to its services and terminate the business relationship.

                                                                              9.6 The Player Account is personal, and only the account holder is entitled to use it. Loco Casino is not responsible if a third party gains access to the Player Account and abuses it. The Player must keep their email address, password, and other security elements strictly confidential and ensure they are not disclosed to others. If the Player has any concerns about the security of their Player Account, including their password or other security elements, they must immediately inform Loco Casino.

                                                                              9.7 The Player agrees to register only one account. If Loco Casino discovers that a Player has more than one Player Account, Monster Casino reserves the right to block all the Player’s accounts, including, but not limited to, transactions related to those accounts, until the issue is fully resolved.

                                                                              9.8 The Player agrees to indemnify Loco Casino for any loss that Loco Casino may suffer in connection with payments or non-payments by the Player, or misuse or improper use of the Player Account.

                                                                              9.9 The Player agrees to refrain from any act or behavior that could damage the reputation of Loco Casino, the website, the games of chance offered, other Players, or the proper functioning of the website and the games of chance offered. It is prohibited to use any procedure or method of any kind to alter or attempt to alter the gaming facilities offered to modify the results.

                                                                              9.10 If Loco Casino has a reasonable suspicion that the Player has altered or attempted to alter the gaming facilities offered, or has used or attempted to use any procedure or method, Loco Casino reserves the right to immediately terminate or block the Player Account and to withhold any funds credited to the Player Account. Loco Casino may also deny the Player access to the services offered by Loco Casino.

                                                                              9.11 The Player is responsible for the technical configuration of the device on which they are playing.

                                                                              10. Customer Service

                                                                              10.1 The Player agrees to contact Customer Service for any request to modify personal data, phone number, and password, to file a complaint, or to submit an appeal. The

                                                                              10.2 If applicable, the creation, update, and/or resolution of a ticket submitted by the Player to Customer Service will be sent to the Player by email.

                                                                              11. Complaints

                                                                              11.1 Complaints must be brought to the attention of Loco Casino no later than 14 days after the event in question via the email address support@lococasino.be ; otherwise, the complaints will be deemed inadmissible. In order to maximize the efficiency and effectiveness of the website and the games of chance offered, all Player requests will be handled as quickly as possible.

                                                                              11.2 In case of a complaint, the Player will provide Loco Casino with the following information; without this information, the complaint cannot be processed:

                                                                              • First and last name

                                                                                • Address

                                                                                  • Date of occurrence

                                                                                    • A clear description of the complaint

                                                                                      • Screenshots and/or other evidence that may help clarify the complaint

                                                                                        11.3 The Player must send the complaint from the email address used to register the Player Account. This ensures the correct link with the Loco Casino customer records.

                                                                                        11.4 A complaint regarding an already processed issue will not be reconsidered. It will be recorded as a query and treated as such for further follow-up. However, if new facts and/or circumstances are presented regarding the previous complaint, Loco Casino will process the new complaint.

                                                                                        11.5 The Player acknowledges that Loco Casino has no obligation to examine or process a complaint that a Player submits about or against another Player. Loco Casino will, at its sole discretion, decide whether or not to take action against any individual suspected of illegal activity or attempting to violate the provisions of these General Terms and Conditions. However, Loco Casino has no obligation to verify that Players are using the website, the games of chance offered, or any other service subject to these General Terms and Conditions in compliance with the provisions of these General Terms and Conditions.

                                                                                        12. Additional Control Measures

                                                                                        12.1 Loco Casino reserves the right to check a Player’s creditworthiness based on the information provided by the Player during the registration process.

                                                                                        12.2 Loco Casino reserves the right to thoroughly verify the Player’s identity, age, and place of residence for any deposit or series of deposits amounting to a total of 2,000 euros or more. These transactions are monitored to prevent money laundering and the financing of terrorism.

                                                                                        12.3 When the Player Account remains inactive for thirty (30) months, Loco Casino will transfer the balance of the account to the Player's registered payment account.

                                                                                        12.4 The aim of Loco Casino is to ensure a safe gaming experience for the Player and their bets. However, certain events may occur that are beyond the control of Loco Casino. Monster Casino will make its best efforts to ensure that the balance of the Player Account is recorded on the online casino platform.
